THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43513 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in not registering the FIR on the basis of the complaint lodged by the petitioner, dated 08.11.2016, as illegal and arbitrary, and consequently direct the 2nd respondent to register FIR pursuant to the complaint, dated 08.11.2016, made by the petitioner against the 3rd respondent. Heard and perused the material available on record. The main grievance of the petitioner is that he lodged a complaint before the 2nd respondent against the 3rd respondent on 08.11.2016, but the 2nd respondent is not registering a case against3rd respondent.

Considering the grievance of the petitioner, the 2nd respondent is directed to register a case against the 3rd respondent if the complaint of the petitioner, dated 08.11.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 2nd respondent, he is at liberty to approach the superior officer of 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J December 15, 2016.
