THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.16955 of 2019 ORDER:

The present writ petition is filed to declare the action of the 4th respondent/Sub-Inspector of Police, Tandur Police Station, in interfering with the civil dispute pending between the petitioner and the respondents 6 & 7 in the writ petition in respect of the land in Survey No.37/3/1 admeasuring Ac.3.00 guntas situated at Madnapur Shivar, Tandur Mandal, Macherial District, as illegal and arbitrary. This Court by order dated 08.08.2019 directed the respondents police not to interfere with the life and liberty of the petitioner except in accordance with law. The said interim order was extended for a period of two weeks. Later, on 14.10.2019 this Court extended the interim order until further orders.

Further, this Court on 22.08.2019 also noted the submission of the Assistant Government Pleader for Home that on receiving a Dial-100 call from 7th respondent-Koritala Srinivas Rao and one Cheerla venkatesh, a GD entry was made and thereafter, the police enquired into the issue and informed both the parties to approach the civil Court as the matter is civil in nature. The allegations made by the petitioner that the 4th respondent is summoning the petitioner

to police station and directing him and his family members not to enter the land were denied by the police authorities. Heard Sri V. Ravi Kiran Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents 1 to 4 and Sri P.Lakshma Reddy, learned counsel appearing for the unofficial respondents 6 and 7.

It is submitted by the learned counsel for the petitioner that there is an injunction order subsisting in favour of the petitioner in IA No.60 of 2019 in O.S.No.35 of 2019 dated 23.07.2019 granted by the learned Junior Civil Judge, Bellampalli. The said fact is not disputed by the learned counsel appearing for the unofficial respondents 6 and 7. The learned Assistant Government Pleader for Home, on written instructions dated 08.08.2019, would submit that on receiving a dial-100 call, an entry was made in General Diary and the police authorities went to the place and enquired about the issue and after enquiry, informed both the parties to approach the civil Court, as noted by this Court on 22.08.2019. In the written instructions, a copy of which is placed on the record of this Court, the 4th respondent has stated that they have never interfered with the civil dispute between the petitioner and unofficial respondents at any point of time.

Recording the said submission made on the basis of written instructions placed on record of this Court, as no further orders are required to be passed, this writ petition is closed. However, there shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ___________________ T.
