THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.12003 OF 2016 ORDER:

The petitioners assail the action of the Station House Officer, Prohibition & Excise Police Station, Alur, Kurnool District in not releasing the property i.e., 47 bags of jaggery each bag containing 50 kgs seized in Crime No.90 of 2016-17 for interim custody. The petitioners/A1 and A2 allegedly committed the offence punishable under Section 34(e) of the A.P. Excise Act, 1968. Heard both sides and perused the record.

The Criminal Petition is disposed of giving liberty to the petitioners to file appropriate application before the Deputy Commissioner of Excise for release of the seized property upon which the Deputy Commissioner shall dispose of the said application within a period of one week from the date of receipt of such application positively.

Pending miscellaneous applications, if any, shall stand closed in consequence.
