This writ petition is filed seeking a writ of Mandamus to declare the action of the 2nd respondent Municipality threatening to demolish the petitioners structures bearing D.Nos.8, 119(1st petitioner, 9 C-32, 8-220-1 and 8-262-2 (Petitioners 2 and 3), D.No.3-83 (4th petitioner) and D.Nos.8-218 & 8-219 (5th petitioner), Main Bazaar, Kalyandurg, Ananthapuram District without following due process of law as illegal and arbitrary and consequently direct the 2nd respondent municipality not to demolish the petitioners structures. Heard Sri Maheswara Rao Kunchem, learned counsel for the petitioners and Sri Md.Saleem, learned Government Pleader for Municipal Administration and Urban Development and perused the record.

At the time of hearing, it is stated by the learned counsel for the petitioners that in similar circumstances, this Court disposed of Writ Petition No.5581 of 2015 and the same is not disputed by Mr.MD Saleem, learned standing counsel appearing for the respondent municipality. Hence, this writ petition is also disposed of in terms of the order dated 06.03.2015 in W.P.No.5581 of 2015 directing the respondents not to demolish the structures of the petitioners without following due procedure prescribed under law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________ A.RAJASHEKER REDDY, J 20.03.
