THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.37142 OF 2015 O R D E R :

The petitioners are residents of Ambedkarnagar, Adilabad, who complained against the 6th respondent, who was working as Auxiliary Nurse Midwife. On the basis of the said complaint, it appears that the 5th respondent-Project Co-Ordinator examined the matter and by his order, dated 03.07.2015, terminated the services of the 6th respondent. The 6th respondent approached the 2nd respondent-District Collector, aggrieved by the termination order. Respondent No.2 vide his orders, dated 06.11.2015, set aside the order dated 03.07.2015 of the 5th respondent and directed him to reinstate the 6th respondent and continue her in the service and report compliance.

The petitioners, aggrieved by the said order of the 2nd respondent, preferred the present writ petition primarily on the ground that they have complained for termination of the 6th respondent and thereafter, the 6th respondent stated to have filed a grievance before the 2nd respondent, which is treated as an appeal and the impugned order is passed without notice to them. I am unable to see any locus standi of the petitioners, who are third parties/villagers on whose complaint a disciplinary action was initiated against the 6th respondent, which resulted in her termination. In the matters of this nature, relating the services of an employee, whether part time or full time, are entirely a matter of satisfaction of the employer, third parties cannot have any locus to question the order of termination or reinstatement, as the case may be.

Even if the grievance of the petitioners is justified, I do not see any locus standi to question the order of reinstatement. Hence, the writ petition cannot be entertained. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
