HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35640 of 2016 ORDER:
This writ petition under Article 226 of the Constitution of India is filed seeking to declare the action of respondents 3 and 4 in not registering any crime and demolishing the room and huts in Plot No.501 in Survey No.59, situated at Sreepuram Colony, Karmanghat Village, Saroornagar Manal, Ranga Reddy District, as illegal and arbitrary.
Heard and perused the material available on record. The main grievance of the petitioners is that the 1st petitioner is the absolute owner of the subject land and. On 27.09.2016 when some persons came and threatened to vacate the place belonging to the petitioner, immediately on 28.09.2016, the 2nd petitioner approached the 3rd respondent and submitted a written complaint, but he refused to receive the same. On 19.10.2016, respondents 5 & 6 with support of respondents 3 & 7 came to the plot of the petitioner and demolished the room and the remaining huts and damaged his property.
Considering the grievance of the petitioners, the 4th respondent is directed not to interfere with the affairs of the petitioners and respondents 3, 5, 6 & 7, more particularly, with the civil disputes pending between them. However, this order will not stand in the way of the 4th respondent to register a case, if any complaint is lodged against the petitioners for cognizable offence. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st October, 2016 KL
