THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4778 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused for grant of anticipatory bail in the event of his arrest in connection with Crime No.176 of 2019 of Jagtial Rural Police Station, Jagtial District, registered for the offence punishable under Section 306 I.P.C.

Heard learned counsel for the petitioner/Accused, and the learned Additional Public Prosecutor representing the respondentState. Perused the record. 3.

The allegation in the complaint is that the petitioner/accused had taken an amount of Rs.20,00,000/- from the deceased Dharmaraju, who is husband of the complainant, for purchase of Ac.0-04 guntas of land on the pretext that he will give share in the said land, but subsequently, the petitioner did not give any land and failed to return the said amount instead, he threatened the deceased. On that the deceased got mental agony, vexed over the life and committed suicide by consuming insecticide poison due to humiliation and abatement and while undergoing treatment, he succumbed to injuries.

Learned counsel for the petitioner/accused would submit that the petitioner is no way concerned with the alleged offence; that the deceased took huge amount from several persons by saying that he will provide double bed room houses in Jagtial and cheated them; that in that regard, the deceased issued a fake allotment letter with forged signature of the District Collector and

handed over to the victims; that after knowing the same, the victims started demanding their money and due to that pressure, the deceased consumed poison and committed suicide and hence, he prays to grant bail to the petitioner.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused.

As seen from the contents of the First Information Report, there are specific allegations that the petitioner had taken huge amount from the husband of the complainant for purchase of land and thereafter, the petitioner did not purchase the land and also failed to return the money instead, he threatened the deceased. Due to mental agony, the deceased committed suicide by consuming insecticide poison.

The allegations levelled against the petitioner are grave in nature. Thus, looking into nature of allegations and the involvement of the petitioner in the commission of offence, this Court is not inclined to grant bail to the petitioner. However, if the petitioner/Accused surrenders before the Court concerned within fifteen (15) days from today and moves an application for grant of bail, the same shall be decided by the Court concerned in accordance with law.

With the above observation, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
