THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9751 OF 2017 ORDER:

Heard learned counsel for the petitioners/A1, among five accused of C.C.No.941 of 2016, pending on the file of II Additional Judicial Magistrate of First Class at Tanuku, which is outcome of the private complaint of the 2nd respondent, covered by Crime No.310 of 2014 of Tanuku Town Police Station, dated 47.11.2014, for the offences punishable under Sections 498A and 506(2) r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act and from the crime and investigation by 1st respondent - SHO, representing by State, the final report filed, that was taken cognizance and in the present petition.

The main prayer is to give direction to the learned Magistrate to early disposal, it is in saying the petitioner/A1 is permanently settled at USA and he is temporarily come down to India to face trial in the case and his future life is in lock for his staying in India.

Having regard to the above, this criminal petition is disposed of, without need of keep pending, much less, ordering notice to the 2nd respondent - defacto complainant, with a direction to the learned Magistrate, subject to other priorities, to give preference in disposal of the case preferably within five months from the date of receipt of the order by commencement of the trial forthwith, if charges already

framed, else to frame any charges, if any material against any of the accused and take up for trial.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
