Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This Writ Petition is filed seeking to declare the action of the 3rd respondent in allotting essential commodities to the in-charge dealer vide proceedings dated 19.3.2015, as arbitrary and illegal. Petitioner is the dealer of fair price shop No.18, Kondramutla Village, Ipur Mandal, Guntur District. On 14.3.2014, the 4th respondent-Tahsildar, inspected the fair price shop of the petitioner, verified the stock and found certain variations. Thereafter, the Tahsildar issued the impugned proceedings dated 19.3.2015 by entrusting the essential commodities to Sri Lakshmi Venkateshwara Mahila Group, Kondlamuttla Village, during subsistence of authorization of the petitioner.

Learned counsel appearing for the petitioner submits that though authorization of the petitioner is neither suspended nor cancelled, the respondents are not supplying the essential commodities to his fair price shop and made in-charge arrangement for distribution to the card holders. Since the impugned order is unsustainable, the same is suspended and the respondents are directed to allot essential commodities to the fair price of the petitioner during subsistence of his authorization.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
