THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4741 of 2015 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.233 of 2015 of Panjagutta Police Station, Hyderabad. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 1st respondent/complainant the police registered a case against the petitioners herein and another for the offences punishable under Sections 420, 468, 506 and 323 read with 34 IPC. The allegations in the complaint, prima facie, reveal the commission of offences punishable under Sections 420, 468, 506 and 323 read with 34 IPC by the petitioners herein. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioners in Cr.No.233 of 2015 of Panjagutta Police Station, Hyderabad. Pending miscellaneous applications, if any, shall stand closed in consequence.
