Smt. Rizwana Sultana, v. Smt. Najamunnisa
THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1940 of 2014 ORDER:
This Criminal Petition under Section 482 of Cr.P.C. is filed by the complainant seeking to quash the proceedings in C.C.No.221 of 2011 pending on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad for the offences punishable under Sections 498-A r/w 34 IPC and Sections 4 & 6 of Dowry Prohibition Act.
According to the complainant-petitioner herein, since there are some differences in the matrimonial life, she initiated the impugned proceedings against her husband and mother-in-law and subsequently, there was reconciliation wherein, all the disputes were settled amicably and she joined her husband to lead matrimonial life. Further her husband is now working in UAE and looking after her children well. Therefore, she does not want to proceed with the matter against her mother-in-law, who is the first respondent herein.
In view of the amicable settlement of the dispute between the parties no purpose would be served in keeping the proceedings pending. Hence, Criminal Petition is allowed and the proceedings in C.C.No.221 of 2011 pending on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad are hereby quashed as against A.3.
Miscellaneous petitions, if any, filed in this revision shall stand closed. _________________ RAJA ELANGO,J 19.02.2016.
