THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Appeal No.868 of 2016 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal is preferred against the order passed by the learned Single Judge dismissing the writ petition granting liberty to the appellant to seek appropriate relief against the third respondent before the Civil Court.
The appellant's grievance before us is that, while his disputes vis-à-vis the third respondent, is undoubtedly a matter which can be agitated before the competent Civil Court, the specific allegation in the writ petition is that the Station House Officer, Annavaram Police Station had tried to dispossess the appellant from the subject property at the instance of the third respondent. As the allegation is one of interference by police officials, in a civil dispute between the appellant and the third respondent, the learned Government Pleader for Home sought time to obtain instructions. Today, the learned Government Pleader for Home, on instructions, submits that, as no complaint was received from the appellant or the third respondent, the question of police officials interfering in these civil disputes does not arise. Sri V.V.N.
Narayana Rao, learned counsel for the appellant, submits that the earlier Station House Officer, who was interfering in the civil disputes between the petitioner and the third respondent, has since been transferred, and the present incumbent is not interfering in the civil disputes.
In view of the submission now made by the learned counsel for the appellant, no further orders are necessary in this writ
appeal. The writ appeal is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
