The petitioners claim to be the owners of land admeasuring Ac.2-06 guntas in Edulanagulapally Village, Ramachandrapuram Mandal, Medak District, and they were shown as pattadars in the records. However, in the Notice of Award Enquiry, dated 04.06.2019, issued for the purpose of land acquisition for public purpose, the respondent authorities have shown the names of respondents 5 to 12 as interested persons. It is the apprehension of the petitioners that the respondent authorities might pay the compensation to respondents 5 to 12, without considering the claim of the petitioners.
Learned Government Pleader, on instructions, would submit that, as a matter of fact, the Award has been made on 22.06.2019 itself, and in view of there being rival claims, the compensation has not been disbursed. He further submits that as there are rival claims with respect to entitlement to compensation, the matter would be referred to the authority constituted under Section 64 of the Land Acquisition Act. In those circumstances, the writ petition is disposed of with a direction to the Land Acquisition Officer to deposit the compensation amount, as determined in the Award made on 22.06.2019, with the authority constituted under Section 64 of the Act, and refer the matter for adjudication of the respective rival claims, as per law.
