ORDER:

This writ petition is filed with the grievance that respondent No.2 has not been releasing the petitioner's tipper bearing registration No. AP 12V 1106.

The petitioner pleaded that the aforesaid vehicle was seized by respondent No.2 on 17.11.2015, when it was proceeding at the outskirts of Amadabakula Village with the load of sand and was kept in the custody of the said respondent. The petitioner further averred that F.I.R.No.159 of 2015 of Kothakota Police Station, Mahaboobnagar District, was registered by respondent No.2 and that on coming to know about the same, he has paid penalty of Rs.25,000/-, vide challan No.9711, dated 30.12.2015, in the State Bank of Hyderabad. As the seized vehicle has not been released by respondent No.2, the petitioner has filed this writ petition. In support of the petitioner's plea that he has paid penalty of Rs.25,000/-, he has filed a copy of the challan.

In the above facts of the matter, the petitioner is permitted to make an application before respondent No.2 for release of the seized vehicle along with the evidence showing payment of penalty. If such an application is filed, respondent No.2 shall examine the same, take an appropriate decision and communicate the same to the petitioner, within a period of three days of receipt of such application. Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal the writ petition, W.P.M.P.No.2297 of 2016 filed by the petitioner for interim relief shall stand disposed of as infructuous.
