THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.2659 OF 2018 ORDER:
When the matter came up for hearing, learned counsel for the petitioner would submit that one of the main reasons for dismissal of I.A.No.962 of 2016 in E.O.P.No.2 of 2013 by the Court of the Election Tribunal-cum-Principal Junior Civil Judge at Suryapet, is that the petitioner has not filed any piece of document before the trial Court to show that he made an application before the Election Officer for recounting of votes and his request was turned down. The learned counsel would further submit that in order to establish that indeed he filed an application before the Election Officer, he would file an application before the trial Court to summon the Election Officer and recording the said submission, the Civil Revision Petition may be closed.
In view of the above submission of the learned counsel for the petitioner, the petitioner is at liberty to file an application before the trial Court, within one week from today, seeking to summon the Election Officer concerned, in which case, the trial Court shall pass appropriate orders on merits without being influenced by this order. With the above observation, the Civil Revision Petition is dismissed. Consequently, miscellaneous petitions, if any pending, shall stand closed. There shall be no order as to costs.
