THE HONOURABLE SRI JUSTICE M. LAXMAN CRIMINAL PETITION No.6097 OF 2023 ORDER:

This petition is filed under Sections 437 and 439 of Criminal Procedure Code, 1973 (Cr.P.C) seeking to grant regular bail to the petitioner who is arrayed as sole accused in Crime No.195 of 2023 of Sangareddy Rural Police Station, Sangareddy District. The offences alleged against the petitioner are under Sections 307 and 449 of the Indian Penal Code. 2.
Briefly the case of the prosecution is that the accused and the complainant are brother and there are disputes between them. The accused had been insisting the complainant to resolve the property disputes, when the complainant did not accept, the accused criminally trespassed into the house of complainant and attempted to hit with hammer. Later, when the complainant and his family members tried to escape, the accused allegedly chase them with a car and dashed them, resulting injuries to the right leg of the complainant and his son and also injury to his daughter.

Heard learned counsel for the petitioner - accused and learned Additional Public Prosecutor for the respondent - State. 4.
On perusal of the material on record, the injuries sustained by all the victims are simple in nature. Further, there are property disputes between the complainant and accused. The petitioner - accused is in remand for more than 80 days and majority of the witnesses are already examined by the police. Considering the above factors, this Court is inclined to consider the request of the petitioner - accused.

Accordingly, the Criminal Petition is allowed and the petitioner - accused shall be released on bail on the following terms and conditions:
(i) The petitioner - accused shall be released on bail on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Sangareddy.
(ii) The petitioner-accused shall undertake that he will not visit the house of the victim and quarrel with them, if the said condition is violated, the prosecution is entitled to seek cancellation of bail granted to the petitioner - accused.
(iii) The petitioner - accused shall not directly or indirectly influence or make any witnesses or complainant. (iv) The petitioner - accused shall make available with the investigating agency for proper investigation and he shall fully cooperate with the investigation agency. He shall not in any manner which will be prejudicial to fair and expeditious investigation.
