ORAL ORDER:
According to petitioners 168 sq yards land was assigned to the father of the petitioner in the year 1999. Petitioners have already constructed a small house therein and on account of increase in the strength of the family, they have taken up further construction and at this stage, notice dated 1.6.2015 was issued to them alleging that illegal construction is being made. Having come to know about issuance of notice, on 18.6.2015 petitioners filed their explanation stating that in view of increase in the family strength, there is need for construction, thus expansion of the building is taken up. It is admitted that constrictuion is being made without obtaining permission.
2. Learned counsel for petitioners submits that building permission application was filed by petitioners in May, 2005 but it was not acted upon. A personal copy of such application is produced, but, it does not contain essential details.
3. Having regard to the submissions made, writ petition is disposed of without expressing any opinion on the merits, directing the competent authority to consider the explanation submitted by the petitioners on 18.6.2015 and pass appropriate orders expeditiously. Further, if any building permission application filed by
petitioners is pending, the same may be considered and pass appropriate orders expeditiously. Till orders are passed on the explanation dated 18.6.2015 or on any building permission application pending, no coercive action should be taken against the petitioners. Petitioners are directed not to make any further construction until orders are passed consequent to the show cause notice issued to the petitioners or on the building permission application, if any pending.
