THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17119 of 2019 ORDER:

It is the case of the petitioner that she made a complaint to the respondent authorities on 26.11.2018 alleging that respondent Nos.5 and 6 have made constructions by encroaching on to the public road, and in spite of the same, no action is being taken. Learned Standing Counsel for Badangpet Municipality appearing for the second respondent, by referring to the documents filed by the petitioner particularly, the sale deed, through which the petitioner acquired the property, would point out that the sketch appended to the sale deed indicates that there are no two roads and there is only one road of 25 feet towards western side.

Having regard to the above, this Curt does not wish to express any opinion on the allegation of the petitioner. However, considering the fact that the petitioner essentially seeks to enforce the alleged easementary rights, the writ petition is disposed of leaving open to the petitioner to workout the remedies in civil Court in accordance with law.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
