THE HONOURABLE SRI JUSTICE K. LAKSHMAN I.A.Nos.2 AND 3 of 2020 IN/AND CRIMINAL PETITION No.5721 OF 2020 ORDER:

This Criminal Petition is filed by the petitioners/A-1 to 5 in Cr.No.145 of 2020, pending on the file of Huzurnagar Police Station, Suryapet District, registered for the offences punishable under Sections 498-A and 313 read with 34 IPC and Sections 3 & 4 of the Dowry Prohibition Act, 1961, to quash the proceedings in the above said crime.

During the pendency of the present Criminal Petition, the parties have compromised the matter and, accordingly, respondent No.2/de facto complainant filed I.A.No.2 of 2020 to permit them to compound and I.A.No.3 of 2020 to allow the criminal petition by quashing the proceedings against the respondent/accused in Cr.No.145 of 2020.

Vide order dated 18.11.2020, this Court, after recording the submissions made by the learned counsel for the petitioners as well as respondent No.2, directed the parties to appear before the Registrar (Judicial-I) of this Court for their identification and also directed the Registrar (Judicial-I) to submit a report by 01.12.2020. In

compliance of the said order dated 18.11.2020, the Registrar (Judicial-I) has submitted his report dated 26.11.2020.

Learned counsel for the petitioners as well as learned counsel for respondent No.2 would submit that petitioner No.1 and respondent No.2 are staying together now.

In the report dated 26.11.2020 of the Registrar (Judicial-I), it is stated that on oral examination, respondent No.2 has stated that she had filed a complaint against the petitioners and the same was registered as Cr.No.145 of 2020 on the file of Huzurnagar Police Station, Suryapet District, for the offences under Sections 498-A and 313 read with 34 IPC and Sections 3 & 4 of the Dowry Prohibition Act, 1961 and that she has compromised the matter with A-1 to A-5 and accordingly she has approached this Court for recording the compromise.

The parties herein have filed a joint memo of compromise dated 02.11.2020. The said joint memo of compromise dated 02.11.2020 and the report of the Registrar (Judicial-I) dated 26.11.2020 are placed on record.

In the grounds of the Criminal Petition, Joint Memo of Compromise and the affidavits filed in support of

I.A.Nos.2 and 3 of 2020, both the 1st petitioner and the 2nd respondent categorically stated that the 2nd respondent has come back to her husband i.e., 1st petitioner herein and they are living together. Since the 1st petitioner and the 2nd respondents have entered into compromise by settling their issues, this Court is of the opinion that it is a fit case to quash the proceedings in Cr.No.145 of 2020 pending on the file of Huzurnagar Police Station, Suryapet District. 8.

In view the said report and also in view of the compromise entered between the petitioners and respondent No.2, I.A.

Nos.2 and are allowed.

Consequently, the Criminal Petition is allowed and the proceedings in Cr.No.145 of 2020, on the file of Huzurnagar Police Station, Suryapet District, are hereby quashed against the petitioners/A-1 to A-5.

Miscellaneous Petitions, pending if any, shall stand closed.
