The petitioner is an authorized fair price shop dealer. His authorisation was suspended pending enquiry in March, 2009, by respondent No.2. The petitioner filed an appeal along with

a stay application before respondent No.1. As no order was passed on the stay application by respondent No.1, the petitioner has filed this Writ Petition.

By interim order, dated 08-04-2009, this Court has suspended the order, of respondent No.2, suspending the petitioner's authorisation.

At the hearing, Mr.K.Venumadhav, learned Counsel for the petitioner, submitted that on the strength of the interim order, granted by this Court, his client is being continued as the fair price shop dealer and that respondent No.2 has not held the enquiry and passed the final order so far.

The learned Assistant Government Pleader for Civil Supplies (AP) has not disputed the above submission of the learned Counsel for the petitioner.

In the light of the above facts, respondent No.2 is directed to hold an enquiry, pass a final order and communicate the same to the petitioner within two months from the date of receipt of this order. Till this process is completed, the petitioner shall be continued as the fair price shop dealer. Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.9624 of 2009, filed by the petitioner for interim relief, is disposed of as infructuous.
