Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.

This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 23.09.2014, as illegal and arbitrary.

The petitioner is the fair price shop dealer of Shop No.26, Guttapadu Village, Orvakal Mandal, Kurnool District. The 4th respondent inspected the aforesaid shop, found variation of 1.66 quintals of PDS rice and though it was mentioned in the acquaintance register that rice was supplied to the 14 card holders, their signatures were not obtained. Accordingly, he submitted a report dated 22.07.2014 to the 3rd respondent. Learned counsel appearing for the petitioner submits that in fact, rice was supplied to the said 14 card holders and only due to inadvertence, their signatures were not obtained. He further submits that there is no complaint from any of the card holders.

However, the petitioner preferred an appeal along

with stay petition before the 2nd respondent on 7.10.2014 seeking suspension of the order passed by the 3rd respondent whereunder his authorization was suspended. The suspension of the authorization is obviously for an indefinite period and so far, no final orders have been passed by the 3rd respondentRevenue Divisional Officer. Under these circumstances, the impugned order dated 23.09.2014 passed by the 3rd respondent is suspended and the 3rd respondent is directed to conduct regular enquiry and pass final orders. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
