HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 21602 of 2015.

ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 151 of Kunool City. While so, the Assistant Supply Officer, Kurnool (Urban) along with Vigilance Officials inspected the fair price shop of the petitioner on 20.4.2015 and noticed some irregularities. Thereafter a panchanama was conducted, stocks were seized and 6-A proceedings were initiated. Based on the same, he submitted a report on 24.4.2015, pursuant to which, the third respondent passed the impugned order dated 28.4.2015 suspending the authorization of the petitioner pending

enquiry. Though the petitioner preferred an appeal before the second respondent challenging the said order, she also filed present Writ Petition.

Since the appeal preferred by the petitioner before the second respondent against the impugned order dated 28.4.2015 is pending adjudication, this Court is not inclined to go into merits or otherwise of the subject matter. Further enquiry initiated against the petitioner is pending. In the circumstances, the petitioner is given fifteen days' time to submit his explanation to the third respondent and the third respondent shall complete the enquiry and pass final orders within thirty days thereafter, after giving due opportunity to the petitioner and following the principles of natural justice in the enquiry process. The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
