THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11871 of 2015 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in seizing the stocks of the petitioner on 15.04.2015 without following the procedure prescribed under the Andhra Pradesh Schedule Commodities Dealers (Licensing, Storage and Regulation) Order, 2008 as arbitrary and illegal.

Heard and perused the material.

Learned counsel for the petitioner, after arguing for some time, submits that the petitioner has submitted representation, dated 20.04.2015, requesting the authorities not to sell the seized stocks. He further submits that the petitioner is having all the required licences and certificates issued by the Commercial Tax Department. In view of the above, the writ petition is disposed of with a direction to the respondents to dispose of the representation, dated 20.04.2015, made by the petitioner within a period of ten (10) days from the date of receipt of copy of this Order. Till then, the respondents are directed not to dispose of the seized stocks. It is, however, made clear that after passing appropriate orders considering the representation made by the petitioner, the respondents are at liberty to proceed against the petitioner in accordance with law. The writ petition is accordingly disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any shall also stand disposed of.
