THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4787 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner/Accused No.2 seeking to quash the proceedings against her in C.C.No.536 of 2017 on the file of XVI Additional Chief Metropolitan Magistrate, Hyderabad. 2.

Heard the learned counsel for the petitioner/Accused No.2, the learned Additional Public Prosecutor representing the 1st respondentState and perused the record. 3.

Though learned counsel for the petitioner filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioner/Accused No.2 before the Court below. 4.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioner, without expressing any opinion on the merits of the case, the personal appearance of the petitioner/Accused No.2 in C.C.No.536 of 2017 on the file of XVI Additional Chief Metropolitan Magistrate, Hyderabad, is dispensed with, while permitting to make her appearance through counsel. However, the petitioner/Accused No.2 shall appear before the Court below as and when her personal appearance is so warranted, in respect of the aforesaid Calendar Case. 5.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
