THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4795 OF 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.1 for grant of anticipatory bail in the event of his arrest in connection with Crime No.147 of 2017 of Women Police Station, Saroornagar, Ranga Reddy, registered for the offences punishable under Sections 498-A and 406 I.P.C and Sections 4 and 6 of the Dowry Prohibition Act, 1961. 2.
Heard learned counsel for the petitioner/Accused No.1 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

The allegation in the complaint would go to show that the petitioner along with other accused harassed the de facto complainant both physically and mentally for additional dowry. 4.
Learned counsel for the petitioner/accused No.1 would submit that without any reason, the de facto complainant left the society of the petitioner within a few days of the marriage; that though the petitioner issued legal notice on 23.05.2016 for restitution of conjugal rights, the complainant never joined the company of the petitioner, however filed a false complaint against the petitioner and others; that the allegations in the complaint are all false and there is no harassment of additional dowry as alleged in the complaint and hence, he prays to grant anticipatory bail to the petitioner.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioner/accused No.1.

As seen from the contents of the First Information Report, there are allegations against the petitioner. Therefore, looking into the nature of the allegations and the gravity of offence alleged against the petitioner, I am not inclined to grant bail to the petitioner. However, if the petitioner/accused No.1 surrenders before the Court concerned within fifteen (15) days from the date of receipt of a copy of this order and moves an application, after giving prior notice to the Public Prosecutor, for grant of bail, the same shall be considered by the Court concerned in accordance with law.

With the above direction, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
