HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.6591 OF 2003

ORDER

This writ petition is filed seeking the following relief: "... to issue a Writ of Mandamus or any other appropriate writ, order or orders, direction or directions declaring the action of the respondent in discontinuing the petitioners from service under proceedings dated 9.4.2003 in Rc.No.B/48/2003 as arbitrary, illegal and unconstitutional and to issue a consequential direction to the respondent to continue the petitioners as field-man and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

While admitting the writ petition on 29-04-2003, this Court in WPMP No.8604 of 2003 granted the interim direction, which reads as under:

"Prima facie from the proceedings dated 1.10.2001, it is evident that the services of the petitioners were regularized and they were fitted into scale of pay.

Under those circumstances, they cannot be treated as temporary or seasonal employees.

It is represented by the learned counsel for the petitioners that ever since their having been appointed in the respondent factory, they were never discontinued. In these circumstances, there shall be interim suspension of the impugned order. Notice."

Learned counsel appearing for the petitioners submits that by virtue of the said interim order, the petitioners were continued in service and hence, no further orders are necessary in the writ petition.

In view of the said submission, the Writ Petition is closed. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
