The criminal petitions are filed for quash of the proceedings against the petitioners, who are A2 and A3, in Cr.No.292 of 2011 on the file of the Station House Officer, Central Crime Station, Hyderabad and in Cr.No.420 of 2011 on the file of the Station House Amberpet Police Station, Hyderabad respectively. The offences alleged are under Sections 66 of the Information Technology Act and Sections 354, 504, 506, 507, 509 read with Section 34 of the Indian Penal Code. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor, appearing for the first respondent. The first respondent refused the notice, which was sent to her.

The complaint shows that there was a marriage proposal between the complainant and the one Narayanadas Ashok Kumar and the complainant refused his proposal. Even thereafter, the said Narayanadas Ashok Kumar sent the petitioners for tying up the marriage alliance and they made it clear to them also that the complainant has no interest in the said proposal. The averments in the complaint are made only touching the names of the petitioners and the allegations are only against Narayanadas Ashok Kumar, that he created email address and is sending ugly sexual emails. Hence, from the complaint itself no case is made out against the petitioners for any of the offences alleged against them. In view of the above, the continuation of further proceedings against the petitioners would only be abuse of process of law.

In the light of the above, the criminal petitions are allowed and the proceedings against the petitioners, who are A2 and A3, in Cr.No.292 of 2011 on the file of the Station House Officer, Central Crime Station, Hyderabad and in Cr.No.420 of 2011 on the file of the Station House Amberpet Police Station, Hyderabad respectively, are hereby quashed. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
