HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.4782 of 2017 ORDER:

The petitioners claim that they were appointed as NMRs in Patancheruvu Gram Panchayat in September 1987. The Gram Panchayat was later upgraded as Municipality and subsequently, merged with the Greater Hyderabad Municipal Corporation (GHMC). The petitioners pray for regularization of their services in accordance with G.O.Ms.No.212, dated 22.04.1994. The petitioners challenge the orders issued by the Government - 1st respondent in G.O.Rt.No.566, Municipal Administration & Urban Development Department, dated 11.08.2016, and contend that the said GO should not be applied to the case of the petitioners and their claim should be without reference to the said orders of the 1st respondent since their regularization proposals were submitted long prior to the issuance of said G.O.Rt., and pending consideration before the competent authority.

Learned counsel for the petitioners submits that the document Ex.P-3 at page 16 and the annexure would show that on 29.05.2009 the Deputy Commissioner, Circle-13 of GHMC, sent the proposals and the same are pending. He submits that constitution of the committee at this stage for considering the claims of the petitioners would only delay the process of regularization and would cause undue hardship to the petitioners.

However, learned counsel for the petitioners fairly submits that a direction be issued to the committee constituted by the 1st respondent under G.O.Rt.No.566 to examine the proposals already pending with them and to take a decision on the claim of the petitioners for regularization within a fixed time.

Having regard to the submissions of the learned counsel for the petitioners, the writ petition is disposed of directing the Committee constituted by the 1st respondent under G.O.Rt.No.566, in so far as Greater Hyderabad Municipal Corporation is concerned, to examine the proposals already submitted to them through the Deputy Commissioner, Circle-13, GHMC, Hyderabad, and dispose of the same within a fixed timeframe, preferably, within a period of two (2) months from the date of receipt of a copy of this order and communicate their decision to the petitioners. If there are no pending proposals and if the petitioners are working as NMRs, the Committee should call for the particulars of the petitioners and consider their entitlement for their regularization. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
