HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.24840 of 2014 ORDER:

The grievance of the petitioner is that she is the owner of an extent of Ac.5.00 of dry land in Sy.Nos.50/2, 50/3 and 50/11 of A.Velagavalasa Village, Bobbili Mandal, Parvathipuram Revenue Division, Vizianagaram District which she obtained as Pasupu Kumkuma through registered gift deed No.1966/2003, dated 15.09.2003 from her fatherC.Bhaskar Rao and since then she has been in effective possession and enjoyment of the said land. Though she made repeated representations to the respondent authorities for issuance of pattadar pass book and title deed, they issued only pattadar pass book No.578 but title deed was not issued.

Hence, the instant writ petition.

2) Learned Government Pleader for Revenue appears on behalf of respondents. No counter is filed.

3) As can be seen, the petitioner claims the land through Pasupu Kumkuma registered gift deed conferred on her by her father and the authorities have already issued patadar pass book, a copy of which is filed along with the material papers by the petitioner. In such an event, there can be no valid and plausible ground for the respondents in not issuing title deed. So far no counter is filed by the respondents showing any valid reason for not issuing the title deed to the petitioner.

4) In these circumstances, this Writ Petition is allowed directing the respondents to issue title deed to the petitioner expeditiously not later than eight (8) weeks from the date of receipt of a copy of this order. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
