THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.4904 of 2015 Order:

This Writ Petition is filed to declare the action of the respondents in not granting permission for installation of horizontal Saw to the petitioner's Saw Mill as illegal and arbitrary. When the matter is taken up for hearing today, both the learned counsel for the petitioner and the learned Government Pleader submitted that in view of the new rules the petitioner has to submit appropriate application before the fourth respondent - Divisional Forest Officer, Visakhapatnam district, who in turn will forward the same to the State Level Committee.

In view of the same, liberty is given to the petitioner to file appropriate application before the fourth respondent and, on filing such application; the fourth respondent shall consider the same and pass appropriate orders thereon in accordance with law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
