This Writ Petition is filed seeking writ of mandamus declaring the impugned order of the 2nd respondent dated 27.03.2018 in proceedings No.332/SA/10/Peddemul/2017/18 confirming the order of removal of petitioner as Field Assistant passed by the 3rd respondent dated 20.12.2017 as illegal and arbitrary. Heard learned counsel for the petitioner and Smt R.Padma Rekha, learned Standing Counsel for the respondents 2 to 5. Learned counsel for the petitioner submits that neither the appellate nor the disciplinary authority has considered the explanation of the petitioner in proper perspective and no plausible reasons are assigned by the appellate authority in the impugned order while removing the petitioner from service, as such, the same is in violation of principles of natural justice. A perusal of impugned order dated 27.03.2018 passed by the 2nd respondent goes to show that there is no proper application of mind while deciding the appeal filed by the petitioner, as such, same is in violation of principles of natural justice.
In view of same, without going into the merits of the case, only on the ground of violation of principles of natural justice and as no reasons are assigned in the impugned order, the impugned order dated 27.03.2018 passed by the 2nd respondent in proceedings No.332/SA/10/Peddemul/2017-18 is set aside and
the appellate authority is directed to reconsider the appeal of the petitioner in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, this Writ Petition is allowed to the extent indicated above. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
