M. Jayakar And 4 Others v. Rt. Rev. Dr. Prof. K. Reuben Mark Fathers Name Not Known To The Petitioners And 2 Others
THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.1995 OF 2019 ORDER:
This revision, under Article 227 of the Constitution of India, is filed by the petitioners aggrieved by the action of the learned Special Judicial First Class Magistrate (For Prohibition & Excise Offences), Nallagonda, in not disposing of I.A.No.1268 of 2018 in O.S.No.417 of 2018. 2.
Heard the learned counsel for the revision petitioners and perused the record.
3.
Learned counsel for the revision petitioners would contend that though I.A.No.1268 of 2018 in O.S.No.417 of 2018 was filed in November, 2018 and in spite of filing of counters by other side, it is adjourned from time to time and no final order is passed so far, which is causing great hardship and inconvenience to the revision petitioners. 4.
The material placed on record reveals that I.A.No.1268 of 2018 was filed in November, 2018. On 02.05.2019, the Court below passed the following order:
"Respondent absent. No representation. Counsel for petitioner reported urgency in the matter. However, giving one more opportunity till 06.05.2019. Failing which, arguments of the respondent will be treated as heard and the matter proceeded further."
5.
It is brought to the notice of this Court that in spite of granting several adjournments till date, no orders are passed in the said I.A. When there are exigencies and when the petitioners are said to have been put to inconvenience and hardship, the Court below ought to have disposed of the said I.A. long back. There is no tenable reason for postponing the subject matter from time to time. 6.
Under these circumstances, the Court below is directed to dispose of I.A.No.1268 of 2018 in O.S.No.417 of 2018, as expeditiously as
possible, preferably, within a period of 30 days, from the date of receipt of a copy of this order.
7.
With the above direction, the Civil Revision Petition is disposed of at the stage of admission. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending shall stand closed. ____________________________ Dr. SHAMEEM AKTHER, J Date: 11.09.2019 ssp
