THE HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No.2601 OF 2016 ORDER:

The Civil Revision Petition is filed under Article 227 of the Constitution of India being aggrieved by the order, dated 28.04.2016, passed in I.A.No.261 of 2016 and I.A.No.380 of 2016 in O.S.No.50 of 2016, by the Judge, Family Courtcum-Additional District and Sessions Judge, East Godavari at Rajahmundry, whereby the learned Judge dismissed both the applications filed seeking to pass an order of attachment before Judgment of the property of M/s.Swatantra Hospitals, Korukonda Main Road, Rajahmundry.

Heard and perused the material available on record. Learned counsel for the petitioner submits that the Court below erroneously dismissed the applications filed by the petitioner herein seeking an order of attachment before Judgment of the property of M/s.Swatantra Hospitals though notices were issued to respondents as to why security shall not be furnished. He further submits that the Court below also failed to observe that the criminal cases are filed against the respondents 1 to 3 by various persons and that the same are pending before the lower Courts. On perusing the impugned order, this Court is of the view that there is nothing to interfere with the order passed by the Court below since it is a money suit. However, the Court below is directed to dispose of the suit as expeditiously as possible, preferably within a period of six months. The civil revision petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
