THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.17020 OF 2019 ORDER: (per SK,J) Challenge in this writ petition is to the notice dated 19.07.2019 issued by the State Bank of India under Rule 8 (6) of Security Interest (Enforcement) Rules, 2002.

However Sri A.Satyanarayana, learned counsel for the State Bank of India, would inform this Court that the impugned notice dated 19.07.2019 has been stayed by the Debts Recovery Appellate Tribunal at Kolkata in Diary No.164 of 2019 on 06.08.2019.

This appeal seems to have been preferred by the auction purchaser in an earlier auction sale which was invalidated by the jurisdictional Debts Recovery Tribunal.

Sri R.Raghunandan Rao, learned senior counsel appearing for Sri T.Bala Mohan Reddy, learned counsel for the petitioner, concedes these factual aspects.

The writ petition is accordingly dismissed as infructuous on this short ground leaving all issues open.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
