ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 3 in Crime No.523 of 2025 of O.U. City Police Station, Hyderabad District, registered for the offences punishable under Sections 316(5), 318(4), r/w 3(5) of the BNS.

The case of the prosecution is that, on 03.12.2025, the de-facto complainant lodged a report before the police stating that the de-facto complainant along with his friends thought to purchase plot and they approached VSN Bhoomi Infra Developers Corporation and they agreed to purchase the two plots at Rs.20,81,000/- and they paid total amount of Rs.16,92,000/- and for the remaining amount, they have given post dated cheques. After receiving all amounts, the owner of the corporation was not responding to the complaint and not even returning the amount to them. Hence, the complainant requested for necessary action. Basing on the same, the police registered a case for the above said offences. 3.
Heard Sri Nakirekanti Upendar, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that the petitioners here are accused Nos.1 and 3 and they are not the owners of the developers corporation and they are only the employees of the said developers corporation and they have
not received the amount and the amount was received by accused No.2 and they are innocent of the said allegations and the victims have falsely implicated the petitioners herein. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioners stating that the allegations against the petitioners are serious and heinous in nature and even after receiving the total amount, they failed to registered the plots, as such, they are not entitled for the anticipatory bail. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, the record shows that no amount was paid to the petitioners herein, who are employees of A.2 and they have stated that the said amount was paid in the year 2021 and they have not filed any suit and there is no reason for lodging the report. Considering the facts and circumstances of the
case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions: i.
The petitioners shall surrender before the Station House Officer, O.U. City Police Station, Hyderabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or
till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
