THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI CIVIL REVISION PETITION No.2168 of 2015 ORDER:

This Civil Revision Petition under Section 115 of the Code of Civil Procedure is filed by the claim petitioners, i.e., the petitioners in E.A.No.1 of 2014 assailing the order dated 01-05-2015 in E.A.No.1 of 2014 in E.A.No.218 of 2013 in E.P.No.358 of 2010 in O.S.No.139 of 2003 on the file of the Additional Senior Civil Judge, Kothagudem. 2.

I have heard the submissions of the learned counsel for the petitioners. I have perused the material record including certified copy of the docket orders in E.A.No.218 of 2013 in E.P.No.358 of 2010 in O.S.No.139 of 2003.

The learned counsel for the petitioners had submitted that the application in E.A.No.218 of 2013 is being adjourned from time to time without conducting any enquiry and that the said course of the court below is causing lot of hardship to the claim petitioners and that E.A.No.1 of 2014, wherein an interim order to maintain status quo was granted, was subsequently disposed of and that E.A.No.218 of 2013 is now ripe for enquiry. During the course of hearing, the learned counsel had confined his prayer for giving a direction to the court below to dispose of E.A.No.218 of 2013, as expeditiously as possible to meet the ends of justice.

Having regard to the facts and the submissions, the Court below is directed to dispose of E.A.No.218 of 2013, as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order. However, the Court below shall give a fair opportunity to both the sides following the procedure established by law while

disposing of the said execution application on merits.

5. Accordingly, the Civil Revision Petition is disposed of, at the stage of admission, with the above directions. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
