HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5463 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/accused under Section 482 Cr.P.C seeking to quash the proceedings in crime No.375 of 2014 of Adibatla Police Station, Ranga Reddy District, registered for the offences punishable under Sections 468 and 420 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State, before notice to respondent No.2/de facto complainant and before admission.

Perused the material on record.

The contention of the petitioners in seeking to quash the F.I.R. proceedings is that the 1st petitioner was owner and possessor of Sy.No.196/A and the same was purchased by the other petitioners; that the de facto complainant as sole plaintiff filed O.S.No.850 of 2014 on the file of III Additional District Judge at Ranga Reddy District, for injunction stating that she purchased an extent of Ac.1.33 guntas in Sy.No.196 from one Saleema Begum; but the same was not reflected in the F.I.R. as to show any link between Saleema Begum and the 1st petitioner as vendor and vendee; and thereby the

F.I.R. to be quashed.

A perusal of the above contention itself goes to show that this Court cannot go into the complicated facts in relation to it but for giving liberty from the material falls short to admit the petition under Section 482 Cr.P.C. this petition is disposed of directing the petitioners to surrender before the learned Magistrate concerned and move for regular bail and in such an event from their entitlement to the concession, the learned Magistrate shall grant bail after hearing Additional Public Prosecutor concerned on the same day with necessary conditions. Needless to say at the post bail stage pending investigation, their presence can be dispensed with. Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
