Respondent/ Complainant Petition under Section 437 and 439 of Cr.P,C, praying that in the circumstances stated in the grounds filed in the Criminal Petition, the High Court may be pleased to enlarge the Petitioners/Accused No. 1 and 4 on bail, pending investigation and trial in Cr. No. 178 /2027 of P.S. Atmakur (S) Suryapet District The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of SRI M V HANUMANTHA RAO Advocate for the Petitioner and Assistant Public Prosecutor for the Respondent, the Court made the following.

ORDER:

THE HONOURABLEJUSTICE G. SRI DEVI CRIMINAI PETITION NO.6552 ot 2021 ORDER:

This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A-1 and 44 to grant bail to them in Cr.No.118 of 2021 on the file of Atmakur Police Station, Suryapet District, registered for the offences punishable under Sections 304-ll, 326, 324,506 read with Section 34tPC.

Heard learned counsel appearing for the petitioners/A-1 and A4, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioners would submit that even as per the allegations in the complaint, all the accused have attended a marriage and that the alleged offences are not attracted against the petitioners. He would further submit that the petitioners have been languishing in jail since 27.07.2021 and that one Gunturu lVadhu, who IS A-2 tn the above crime, has already been granted anticipatory bail and that the case of the petitioners stands on the same footing. He would further submit that the petitioners are law aiding citizens and ready to abide by any condition that may be imposed by this Court in the event of their enlargement on bail.

Learned Assistant Public Prosecutor opposed to grant bail to the petitioners _.--.---

Having regard to the facts and circumstances and looking into the nature of allegations leveled against the petitioners, without adverting to the merits of the case, I am inclined to grant bail to the petitioners/A-1 and 44.

The Cdminal Petition is allowed and the petitioners/A-1 and 44 are directed to be released on bail subject to the following terms and conditions.

(1)fhe petitioners/A-1 and 44 shall be released on bail on their executing a personal bone to the tune of Rs.50,000/- (Rupees fifty thousand only) each with two sureties for a like sum each to the satisfaction of the Prlncipal Judicial First Class Magistrate, Suryapet.

(2) The petitioners/A-'1 and 44 shall appear before the lnvestigating Authorities on every Saturday between 2.00 PM and 5.00 PM till completion of investigation and filing of final report.

(3) the petitioners/A'l and A4 shall not interfere with the investigation, intimidate or induce the material witnesses and shall cooperate with the investigating agency.

(4) the petitioners/Al and 44 shall appear before the Court concerned personally on each date of hearing till conclusion of trial.

(5) the petitioners/A1 and 44 shall not misuse the liberty granted to them.

[Vliscellaneous applications, if any pending in this criminal petition, shall stand closed.
