THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14584 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking verbatim the following relief: "For the reasons stated in the accompanied affidavit it is prayed that this Hon'ble Court may be pleased to issue writ of mandamus by declaring the action of the Respondents more particularly respondent nos 3 to 5 to provide Police protection and to assist the Respondent No.2 during the survey dated 28-04-2018 at 11:00 am and may pass any such other Order or Orders as this Hon'ble Court may deem fit and proper in the circumstances of the case, in the interest of Justice."

I have heard the submissions of Sri K.V.Satyanarayana, learned Senior Counsel appearing for the petitioners, and of the learned Government Pleader for Home (Telangana) appearing for the respondents 1 & 3 to 5, and of the learned Government Pleader for Revenue (Telangana) appearing for the 2nd respondent. I have perused the material record.

Though in this writ petition, the 6th unofficial respondent is impleaded, permission is sought to delete the 6th respondent from the array of parties stating inter alia that the 6th respondent is not a necessary party. Permission is accorded. The 6th respondent is, accordingly, deleted from the array of the respondents. 4.

The request of the writ petitioners is to provide police protection by directing the respondents 3 to 5 to assist the 2nd respondent during the conduct of survey on 28.04.2018 at 11.00 A.M., as per the orders of this Court.

Learned Government Pleader for Home, on instructions, would submit that in view of the orders of a Division Bench of this Court, the survey is to be conducted and since the apprehension of the petitioners is that some law and order problem may arise at the time of conduct of the survey, the present writ petition is filed. 6.

Learned Senior Counsel for the petitioners also would submit that if a direction, as sought for, is given, the survey could be conducted peacefully and such a course would meet the ends of justice.

Recording the submissions, the Writ Petition is ordered, as prayed for. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
