I.A.No.1 of 2026 (On Being Mentioned) The present Interlocutory Application has been filed by the respondent No.34 (Developer) in W.A.No.396 of 2022.
Learned counsel appearing for the applicant/Developer submits that a portion of the first paragraph of the judgment dated 21.04.2026, passed by this Court in W.A.No.396 of 2022, requires modification since the said paragraph may not accurately reflect the true state of affairs. The first paragraph of the judgment is set out below:
'Learned Standing Counsel appearing for the appellants submits that nothing further remains in the Writ Appeal since the flat purchasers have paid entire consideration to the Developer.'
Counsel submits that the statement of learned Standing Counsel, as recorded in the first paragraph of the judgment dated 21.04.2026, to the effect that the flat purchasers have paid the entire sale consideration to the Developer, is incorrect, since there are some flat purchasers who still owe amounts to the Developer. It is further submitted that the flat purchasers may approach the
Developer along with relevant records to clarify the position. If any amounts remain outstanding, the flat purchasers may pay the same.
The parties are represented.
Considering the submissions made, we do not find any difficulty in modifying the first paragraph of the judgment dated 21.04.2026.
I.A.No.1 of 2026 is accordingly allowed and disposed of by modifying the first paragraph of the judgment dated 21.04.2026 passed by this Court in W.A.No.396 of 2022 in the following manner:
'The learned Standing Counsel appearing for the appellants submits that the flat purchasers may approach the Developer with the relevant records to verify whether the flat purchasers have paid the entire amount or whether any amounts remain due and payable to the Developer. The registration of the flats shall be carried out by the Housing Board in accordance with the agreement between the parties. The Standing Counsel further submits that the Writ Appeal may be disposed of on the above basis.'
Paragraph Nos.2 and shall remain unchanged.
The Registry is directed to carry out the above modification in the judgment dated 21.04.2026 and issue a fresh order copy to the parties.
