THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.4882 OF 2018 ORDER:
This petition is filed by the petitioners-A1 and A2 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.16 of 2018 on the file of the Station House Officer, Atmakur Police Station, Suryapet District, registered for the offences punishable under Sections 415, 417, 418, 420 and 506 IPC.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

It is evident from the record that there is an agreement of sale between the parties to the litigation. It is contended on behalf of the petitioners that the de facto complainant did not pay the balance amount of Rs.19,87,500/- on or before 20.04.2017 as agreed between the parties by way of written agreement. A notice was also issued by the petitioner-A1 on 27.10.2017. The matter appears to be civil in nature. The truth or otherwise of the allegations made against the petitioners in the F.I.R. are required to be investigated. However, the interest of the petitioners-A1 and A2 is required to be protected. 4.
Therefore, the Station House Officer/Investigating Officer concerned is directed to complete the investigation and file final report, without arresting the petitioners-A1 and A2 in the above crime. The petitioners-A1 and A2 shall co-operate with the investigating officer.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
