HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.397 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the inaction of respondents 1 to 4 in taking action on the representations submitted by the petitioners and others against the illegal encroachment of Kunta land, as illegal and arbitrary. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue for respondents 1 to 4. With their consent, the Writ Petition is disposed of at the stage of admission itself. There is no necessity to put respondents 5 to 8 on notice since this Court is not venturing to adjudicate the case on merits.

The limited grievance of the petitioners in this writ petition is that though the petitioners along with others submitted representations to 2nd respondent complaining about illegal encroachments of Kunta land admeasuring Acs.7.62 cents situated in survey No.221 of Addanki Village by unofficial respondents herein, till date no action has been taken.

Learned AGP would submit that a suitable direction may be given for disposal of the representations of the petitioners, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-District Collector to deal with the representation submitted by the

petitioners along with other villagers on 01.02.2016 complaining about illegal encroachments of Kunta land by respondents 5 to 8 herein and pass appropriate orders thereon, in accordance with law, after hearing the petitioners and other aggrieved persons, if any including respondents 5 to 8 herein, at the earliest.
