HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.23592 of 2015 ORDER:

The Writ Petition is filed seeking the following relief: "To issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.5 in issuing 6A proceedings dated 25.06.2015 to the petitioner as illegal, arbitrary and unconstitutional of India and consequently direct the respondents to restore the authorisation to the petitioner and supply the essential commodities to the fair price shop No.7 and pass such other orders."

Now, the learned Government Pleader for Civil Supplies, on instructions, submits that, after filing of the Writ Petition, the fourth respondent suspended the authorization of the petitioner vide proceedings dated 23.07.2015.

Hence, the petitioner is permitted to withdraw the Writ Petition with liberty to file a fresh Writ Petition challenging the order of suspension.

Granting liberty as sought for, the Writ Petition is dismissed as withdrawn.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
