O R D E R

The case of the petitioners is that they were assigned the lands admeasuring Ac.0.36 cents in Sy.No.662/12, Ac.3-00 cents in Sy.No.662/13 and Ac.2-79 cents in Sy.No.661 of Vempalli Village, Madanpalli Revenue Mandal, Chittoor District respectively and later they have developed the said land and made it fit for cultivation. While so, the 2nd respondent at the instance of local M.L.A. is trying to dispossess the petitioners. Aggrieved by the same, the present writ petition is filed.

Basing on the averments in the counter affidavit, the learned Assistant Government Pleader for Revenue submits that the adjacent land owners consented for resumption of their land for the purpose of construction of the houses to the poor people and even the petitioners also gave their consent for resumption of their land. In the counter it is also stated that the respondents would follow due process of law before resuming their land.

In view of the statements made in the counter affidavit, which are reiterated by the leaned Assistant Government Pleader for Revenue, the writ petition is disposed of directing the respondents not to dispossess the petitioners without following due process of law. No costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
