THE HONOURABLE SMT JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION NO. 4351 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in connection with Crime No.165 of 2022 on the file of Station House Officer, Shankarpally Police Station, Ranga Reddy District registered for the offence punishable under Sections 304-II and 337 of Indian Penal Code (IPC) and under Section 185 (A) of the Motor Vehicles Act, 1988.

Heard the learned counsel for the petitioner/Accused and the learned Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that on 21.03.2022 at about 10.30 p.m., the petitioner had driven the Swift Car bearing No.TS 07 EA 5770 in a rash and negligent manner in high speed in an intoxicated condition and dashed against the Wagon R Car bearing No.AP 29 J 5757, coming in opposite direction, due to which one person died and the other inmates of the opposite car sustained severe bleeding injuries and fractures.
Learned counsel for the petitioner contends that the accident occurred due to the contributory negligence of the drivers of both cars. He further submits that petitioner herein also sustained injuries in the said accident. He also submits that except filing of charge sheet, the entire investigation is completed. Therefore, prays the Court to grant anticipatory bail to the petitioner. 4.
Learned Public Prosecutor opposed granting of bail and also states that investigation is completed and charge sheet is yet to be filed.

Considering the record before this Court and considering the above submissions, this Court finds it a fit case to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail subject to the following conditions:
i) The petitioner/Accused is directed to surrender before the Station House Officer, Shankarpally Police Station, Ranga Reddy District within a period of ten (10) days from today and on such surrender, the petitioner shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties each for a like sum to the satisfaction of Station House Officer, Shankarpally Police Station,
Ranga Reddy District. The petitioner shall appear before the concerned police station on every Sunday between 10.00 a.m., and 2.00 p.m., for a period of two months or till filing of charge sheet whichever is earlier.
ii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C.
Miscellaneous applications, if any pending, shall stand closed.
