O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the unsuccessful applicant in O.A.No.183 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (hereinafter, 'the Tribunal'). His prayer therein was to declare the action of the second respondent in not disposing of his appeal dated 29.06.2017 as illegal. By order dated 26.02.2018, the Tribunal opined that as the appeal filed under Rule 26(a) of the Andhra Pradesh State and Subordinate Services Rules, 1996 (for brevity, 'the Rules of 1996') is to be disposed of within the maximum time of one year provided under sub-rule (c) thereof in the event the appellate authority is not the Head of the Department or the Government, no cause was made out to hustle the said appellate authority to dispose of the petitioner-applicant's appeal. Sri K.Ramachandra, learned counsel for the petitioner-applicant, would however point out that his client's appeal was dated 29.06.2017 and the one year period stipulated under Rule 26(c) of the Rules of 1996 is to come to an end shortly hereafter.
In that view of the matter, the writ petition is disposed of directing the second respondent appellate authority to abide by the mandate of Rule 26(c) of the Rules of 1996 and pass appropriate orders in accordance with law upon the appeal dated 29.06.2017 filed by the petitioner-applicant. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ________________ SANJAY KUMAR, J ________________ M.
