HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos 10723 OF 2017 And 11341 OF COMMON ORDER:
As the subject land in both the writ petitions is one and the same, both these writ petitions are being disposed of together.
The case of the petitioners is that the petitioners are the absolute owners and possessors of land in Sy.No.105 of Amangal, Hayathnagar to an extent of Ac.0-39 guntas having acquired the same through succession and inheritance from their father Late Maisaiah. Since the date of Kasara, their father was recorded as pattadar and possessor of land to an extent of Ac.0-39 guntas and he was issued pattadar passbook and title deeds. After death of father of the petitioners, the petitioners are enjoying the land under their possession without any interruption. The petitioners sold some extent of land to other parties and they are in possession of remaining land. The Government started erection work of Electrical sub-station in the premises owned and possessed by the petitioners stating that land under the possession of the petitioners is in Sy.No.60 of Anmagal, Hayathnagar and not in Sy.No.105. On that the petitioners filed W.P.No.11341 of 2016 with a prayer to restrain the respondent-authorities from erecting electrical sub-station in the premises of Sy.No.105. The petitioners submitted
application before the respondent-authorities for demarcation of Sy.No.105 as per the documents filed by them along with requisite fee. Aggrieved by the action of respondentauthorities in not conducting survey in respect of Sy.No.105, the present writ petition is filed.
Heard learned counsel for the petitioner.
It is stated that the Government started erection work of Electrical sub-station in the premises owned and possessed by the petitioners stating that land under the possession of the petitioners is in Sy.No.60 of Anmagal, Hayathnagar and not in Sy.No.105. The dispute appears to be with regard to survey numbers. Since it is stated that Sy.No.60 is allotted for construction of electrical sub-station, the 3rd respondent is directed to consider the application of the petitioners for conducting of survey and demarcation of the same after issuing notice to the 4th respondent-Superintendent Engineer (Operation), Telangana State Southern Power Distribution Corporation Limited, Ranga Reddy District in WP.No.11341 of 2016 and after filing objections dispose of the application filed by the petitioners for survey and take action. Accordingly, these writ petitions are disposed of.
