When this matter is taken up for hearing, it is noticed that now the petitioner has attained the age of superannuation. The petitioner filed this writ petition challenging the award passed by the Labour Court in I.D.No.156 of 2000 dated 3.12.2001, wherein no relief was granted to the petitioner. The petitioner is seeking reinstatement into service.

This Court having perused the material available on record and considered the submissions made by the parties, is of the view that the relief sought by the petitioner cannot be granted at this point of time as the petitioner attained the age of superannuation. However, this writ petition can be disposed of directing the 2nd respondent to pay service benefits of the petitioner for the services rendered by him prior to his removal, if not already paid.

Accordingly, the Writ Petition is disposed of directing the 2nd respondent to pay the service benefits of the petitioner for the services rendered by him prior to his removal, if not already paid, within a period of four weeks from the date of receipt of a copy of this order.
