CVNR, J CC 1126/2016 ORDER:
This contempt case is filed alleging wilful disobedience of order dt.22.01.2016 in W.P. No.1785 of 2016.
At the hearing, Mr. N. Ashok Kumar, learned Standing Counsel for the Greater Hyderabad Municipal Corporation (GHMC), appearing for respondent Nos.1 to 3, submitted that the GHMC has rejected the application of contemnor No.4 for regularization of the unauthorized constructions made by him on 24.01.2017. Inasmuch as no specific evidence is placed before this Court to prove that after 22.01.2016, the date on which interim order was passed by this Court in W.P. No.1785 of 2016, contemnor No.4 has raised constructions in violation of the said order and the further fact that his application for regularization was rejected, I do not find any reason to proceed further with the contempt case.
The contempt case is accordingly closed, however, with liberty to the petitioner to pursue his legal remedies in the event respondent No.4 uses the part of the building which is not covered by the sanctioned plan.
