THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32594 OF 2016 ORDER :

It is the case of the petitioners that basing on the application of the 4th respondent dated 02.12.2015 for change of entries in the revenue records, they were issued notice dated 23.01.2016 by the 3rd respondent calling upon them to produce the records such as pattedar pass books and link documents in respect of the subject property. It is stated that though petitioners have filed objections on 08.02.2016 stating that suit OS No.305 of 2015 on the file of the Junior Civil Judge, Anantapur, filed by the 4th respondent in respect of Ac.1.63 cents of property is pending, the 3rd respondent is trying to dispose of the application of the 4th respondent and trying to make entries in favour of the 4th respondent. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since the petitioners have already filed objection to the notice dated 23.01.2016 issued by the 3rd respondent on 08.02.2016, the 3rd respondent is directed to consider the objections of the petitioners on the said notice, before passing any orders on the application of the 4th respondent. The 3rd respondent shall also take into account the suit O.S.No.305 of 2015 filed by the 4th respondent.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands dismissed.
